Pourtant, dans la r\u00e9alit\u00e9 du terrain, on observe trop souvent une approche minimaliste : formations b\u00e2cl\u00e9es, dispositifs peu engageants, sessions g\u00e9n\u00e9riques mal adapt\u00e9es aux risques r\u00e9els, et surtout, une logique de conformit\u00e9 administrative plut\u00f4t que d&rsquo;impact humain.<\/p><p id=\"ember7343\" class=\"ember-view reader-text-block__paragraph\">On forme parce qu\u2019il le faut. Parce que c\u2019est obligatoire. Parce qu\u2019il y a un contr\u00f4le. Et parfois, parce que le service RH nous relance. Mais derri\u00e8re ces obligations l\u00e9gales se cache une opportunit\u00e9 bien plus profonde : celle d\u2019ancrer de vrais r\u00e9flexes de pr\u00e9vention, de renforcer la culture d\u2019entreprise, et de faire monter en comp\u00e9tence des \u00e9quipes mieux pr\u00e9par\u00e9es aux risques du quotidien.<\/p><p id=\"ember7344\" class=\"ember-view reader-text-block__paragraph\">Au Luxembourg, les obligations de formation en mati\u00e8re de s\u00e9curit\u00e9 sont encadr\u00e9es par plusieurs textes fondamentaux.<\/p><p id=\"ember7345\" class=\"ember-view reader-text-block__paragraph\">Le <strong>Code du travail<\/strong> impose \u00e0 l\u2019employeur d&rsquo;assurer la s\u00e9curit\u00e9 et la sant\u00e9 des salari\u00e9s, notamment via <strong>des formations appropri\u00e9es<\/strong> (Article L.312-1 \u00e0 L.312-4). Le <strong>r\u00e8glement grand-ducal du 9 juin 2006<\/strong> compl\u00e8te cette obligation en pr\u00e9cisant que le personnel doit \u00eatre form\u00e9 aux risques auxquels il est expos\u00e9, ainsi qu\u2019\u00e0 l\u2019utilisation des \u00e9quipements de travail et des \u00e9quipements de protection individuelle.<\/p><p id=\"ember7346\" class=\"ember-view reader-text-block__paragraph\">Le <strong>travailleur d\u00e9sign\u00e9<\/strong>, s\u2019il est en interne ou externalis\u00e9, a aussi pour mission de v\u00e9rifier que les salari\u00e9s re\u00e7oivent les formations n\u00e9cessaires, adapt\u00e9es aux postes, aux \u00e9volutions techniques, et aux incidents constat\u00e9s.<\/p><p id=\"ember7347\" class=\"ember-view reader-text-block__paragraph\">Dans certains cas, les formations sont directement <strong>rendues obligatoires par voie r\u00e9glementaire<\/strong>, en lien avec l\u2019activit\u00e9 exerc\u00e9e ou les \u00e9quipements utilis\u00e9s.<\/p><h3 id=\"ember7348\" class=\"ember-view reader-text-block__heading-3\">Exemples de formations obligatoires par secteur<\/h3><p id=\"ember7349\" class=\"ember-view reader-text-block__paragraph\"><strong>1. B\u00e2timent \/ Travaux publics<\/strong><\/p><p id=\"ember7350\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p><ul><li>Trainings <strong>travail en hauteur<\/strong> (\u00e9chafaudage, harnais, nacelle)<\/li><li>Habilitation \u00e9lectrique BT-H \/ BT-B \/ HT-A selon niveau d\u2019exposition<\/li><li>Formation \u00e0 la manipulation des <strong>produits chimiques<\/strong> (FDS, pictogrammes, EPI)<\/li><li>Trainings <strong>premiers secours<\/strong> et incendie pour les chefs d\u2019\u00e9quipe<\/li><\/ul><p>\u00a0<\/p><p id=\"ember7351\" class=\"ember-view reader-text-block__paragraph\"><strong>2. Industrie<\/strong><\/p><p id=\"ember7356\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p><ul><li>Trainings <strong>SST (sauveteur secouriste du travail)<\/strong><\/li><li>Trainings <strong>incendie avanc\u00e9e<\/strong> (utilisation de RIA, interventions sur feu r\u00e9el)<\/li><li>Habilitation aux <strong>machines sp\u00e9cifiques<\/strong> (presse, d\u00e9coupe, robotique)<\/li><li>Trainings <strong>ATEX<\/strong> dans les zones \u00e0 atmosph\u00e8res explosives<\/li><\/ul><p>\u00a0<\/p><p id=\"ember7357\" class=\"ember-view reader-text-block__paragraph\">Selon les donn\u00e9es crois\u00e9es de l\u2019AAA et de l\u2019Inspection du Travail et des Mines (ITM), environ <strong>32 % des accidents du travail au Luxembourg<\/strong> impliquent un salari\u00e9 <strong>non form\u00e9 ou insuffisamment form\u00e9<\/strong> au poste ou au risque sp\u00e9cifique.<\/p><p id=\"ember7358\" class=\"ember-view reader-text-block__paragraph\">Un audit interne de 2023 men\u00e9 dans 46 entreprises a r\u00e9v\u00e9l\u00e9 que <strong>plus de 58 %<\/strong> des plans de formation n\u2019\u00e9taient <strong>pas \u00e0 jour<\/strong>, et que la <strong>tra\u00e7abilit\u00e9 des formations<\/strong> (pr\u00e9sences, attestations, remises \u00e0 niveau) \u00e9tait lacunaire dans <strong>une entreprise sur trois<\/strong>.<\/p><p id=\"ember7359\" class=\"ember-view reader-text-block__paragraph\">L\u2019\u00e9tude annuelle de l\u2019INFPC, elle, indique que si <strong>87 % des entreprises luxembourgeoises<\/strong> d\u00e9clarent organiser des formations internes, <strong>moins de 40 %<\/strong> incluent <strong>des volets li\u00e9s \u00e0 la sant\u00e9 et s\u00e9curit\u00e9 au travail<\/strong>.<\/p><p id=\"ember7360\" class=\"ember-view reader-text-block__paragraph\">Les recommandations de l\u2019<strong>ITM<\/strong> sont claires : l\u2019entreprise doit <strong>adapter le contenu des formations<\/strong> \u00e0 l\u2019\u00e9valuation des risques du DUERP, et non se contenter de formations g\u00e9n\u00e9riques. La <strong>tra\u00e7abilit\u00e9<\/strong> doit \u00eatre assur\u00e9e, tout comme la <strong>mise \u00e0 jour r\u00e9guli\u00e8re<\/strong> en fonction des postes et de l\u2019\u00e9volution des outils ou processus.<\/p><p id=\"ember7361\" class=\"ember-view reader-text-block__paragraph\">Le <strong>CGDIS<\/strong> recommande que <strong>100 % des salari\u00e9s<\/strong> sachent \u00e9vacuer les locaux, rep\u00e9rer les moyens d\u2019alerte et de lutte contre l\u2019incendie, et agir de fa\u00e7on coordonn\u00e9e. Il rappelle \u00e9galement que les chefs d\u2019\u00e9quipe ou managers ont un <strong>r\u00f4le renforc\u00e9<\/strong> et doivent \u00eatre form\u00e9s \u00e0 la coordination en situation de crise.<\/p><p id=\"ember7362\" class=\"ember-view reader-text-block__paragraph\">Le <strong>SNJ (Service National de la Jeunesse)<\/strong> impose lui aussi que les professionnels encadrant des enfants ou des jeunes suivent <strong>des formations sp\u00e9cifiques reconnues<\/strong>, dispens\u00e9es uniquement par des organismes agr\u00e9\u00e9s. OFSIP fait partie de ces organismes.<\/p><p id=\"ember7363\" class=\"ember-view reader-text-block__paragraph\">Chez OFSIP, nous observons au quotidien que <strong>la formation obligatoire est trop souvent per\u00e7ue comme une contrainte administrative<\/strong>, alors qu\u2019elle devrait \u00eatre <strong>un levier de mont\u00e9e en comp\u00e9tence et de s\u00e9curisation collective<\/strong>.<\/p><p id=\"ember7364\" class=\"ember-view reader-text-block__paragraph\">Notre recommandation est de ne <strong>jamais s\u00e9parer le plan de formation du DUERP<\/strong> : les risques identifi\u00e9s doivent \u00eatre reli\u00e9s \u00e0 des actions concr\u00e8tes, y compris en termes de sensibilisation et d\u2019apprentissage.<\/p><p id=\"ember7365\" class=\"ember-view reader-text-block__paragraph\">Nous pr\u00e9conisons aussi de <strong>varier les formats<\/strong> : distanciel, r\u00e9alit\u00e9 virtuelle, ateliers immersifs, mises en situation\u2026 Il ne s\u2019agit pas de faire \u00ab\u00a0un PowerPoint et une signature\u00a0\u00bb, mais de provoquer de vraies prises de conscience.<\/p><p id=\"ember7366\" class=\"ember-view reader-text-block__paragraph\">Autre point important : la <strong>r\u00e9gularit\u00e9<\/strong>. Une formation suivie une fois tous les 10 ans ne permet pas de maintenir les r\u00e9flexes. Il faut <strong>rafra\u00eechir les savoirs tous les 2 \u00e0 5 ans<\/strong>, selon les postes.<\/p><h3 id=\"ember7367\" class=\"ember-view reader-text-block__heading-3\">Le plan de formation : un outil strat\u00e9gique, pas un tableau Excel<\/h3><p id=\"ember7368\" class=\"ember-view reader-text-block__paragraph\">Un plan de formation efficace, ce n\u2019est pas juste une liste de stages annuels. C\u2019est une <strong>cartographie des comp\u00e9tences \u00e0 acqu\u00e9rir<\/strong>, une projection des \u00e9volutions \u00e0 venir, et un <strong>outil de dialogue entre direction, RH, managers et travailleurs d\u00e9sign\u00e9s<\/strong>.<\/p><p id=\"ember7369\" class=\"ember-view reader-text-block__paragraph\">Il doit prendre en compte :<\/p><p id=\"ember7370\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p><ul><li>Les <strong>obligations r\u00e9glementaires<\/strong><\/li><li>Les <strong>incidents pass\u00e9s ou \u00e9vit\u00e9s de peu<\/strong><\/li><li>Les <strong>risques identifi\u00e9s<\/strong> (DUERP)<\/li><li>Les <strong>projets futurs<\/strong> (nouveaux \u00e9quipements, d\u00e9m\u00e9nagement, fusion\u2026)<\/li><\/ul><p>\u00a0<\/p><p id=\"ember7371\" class=\"ember-view reader-text-block__paragraph\">Il doit aussi pr\u00e9voir un <strong>budget<\/strong>, une <strong>p\u00e9riodicit\u00e9<\/strong>, une <strong>tra\u00e7abilit\u00e9 des suivis<\/strong>, et permettre une <strong>r\u00e9activit\u00e9 en cas de besoin urgent<\/strong> (accident, changement d\u2019\u00e9quipe, retour de cong\u00e9 maternit\u00e9, etc.).<\/p><h3 id=\"ember7372\" class=\"ember-view reader-text-block__heading-3\">Le cofinancement des formations par l\u2019INFPC<\/h3><p id=\"ember7373\" class=\"ember-view reader-text-block__paragraph\">Le <strong>cofinancement \u00e9tatique<\/strong> des formations professionnelles est un outil trop souvent m\u00e9connu. Pourtant, il permet aux entreprises luxembourgeoises de <strong>r\u00e9cup\u00e9rer jusqu\u2019\u00e0 20 %<\/strong> du montant investi dans leurs plans de formation.<\/p><p id=\"ember7374\" class=\"ember-view reader-text-block__paragraph\">\u2705 <strong>Qui peut en b\u00e9n\u00e9ficier ?<\/strong> Toute entreprise l\u00e9galement \u00e9tablie au Luxembourg, \u00e0 jour de ses obligations sociales et fiscales, employant du personnel sous contrat luxembourgeois.<\/p><p id=\"ember7375\" class=\"ember-view reader-text-block__paragraph\">\u2705 <strong>Quelles formations sont \u00e9ligibles ?<\/strong> Les formations internes ou externes <strong>ayant un lien avec l\u2019activit\u00e9 de l\u2019entreprise<\/strong>, la s\u00e9curit\u00e9, la pr\u00e9vention, les techniques professionnelles, les soft skills\u2026 Sont \u00e9ligibles les formations SST, incendie, gestes et postures, mais aussi des formations techniques ou manag\u00e9riales.<\/p><p id=\"ember7376\" class=\"ember-view reader-text-block__paragraph\">\u2705 <strong>Quels montants ?<\/strong><\/p><h3 id=\"ember7377\" class=\"ember-view reader-text-block__heading-3\">1. Taux de cofinancement de base : 15\u202f%<\/h3><p id=\"ember7378\" class=\"ember-view reader-text-block__paragraph\">L&rsquo;\u00c9tat accorde une aide financi\u00e8re correspondant \u00e0 <strong>15\u202f% du montant investi en formation au cours de l\u2019exercice<\/strong>, comme l\u2019indique le site officiel de l\u2019INFPC<\/p><hr class=\"reader-divider-block__horizontal-rule\" \/><h3 id=\"ember7379\" class=\"ember-view reader-text-block__heading-3\">2. Majorations possibles : jusqu\u2019\u00e0 35\u202f% sur les co\u00fbts salariaux<\/h3><p id=\"ember7380\" class=\"ember-view reader-text-block__paragraph\">Pour certaines cat\u00e9gories de salari\u00e9s \u2014 notamment ceux <strong>sans dipl\u00f4me reconnu et avec moins de 10 ans d\u2019anciennet\u00e9<\/strong>, ou ceux <strong>\u00e2g\u00e9s de plus de 45 ans<\/strong> \u2014 il existe une <strong>majoration de l\u2019aide jusqu\u2019\u00e0 20\u202f% suppl\u00e9mentaires<\/strong>, appliqu\u00e9e sur le volet salaires des co\u00fbts de formation<\/p><p id=\"ember7381\" class=\"ember-view reader-text-block__paragraph\">Cela porte le taux global de remboursement possible aux alentours de <strong>35\u202f%<\/strong> pour ces profils sp\u00e9cifiques.<\/p><hr class=\"reader-divider-block__horizontal-rule\" \/><h3 id=\"ember7382\" class=\"ember-view reader-text-block__heading-3\">3. Plafond pour l\u2019investissement (selon la taille de l\u2019entreprise)<\/h3><p id=\"ember7383\" class=\"ember-view reader-text-block__paragraph\">Le montant d\u2019investissement en formation pour lequel l\u2019aide est calcul\u00e9e est plafonn\u00e9 selon la masse salariale :<\/p><p id=\"ember7384\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p><ul><li><strong>1 \u00e0 9 salari\u00e9s<\/strong> : jusqu\u2019\u00e0 <strong>20\u202f% de la masse salariale<\/strong><\/li><li><strong>10 \u00e0 249 salari\u00e9s<\/strong> : jusqu\u2019\u00e0 <strong>3\u202f% de la masse salariale<\/strong><\/li><li><strong>250 salari\u00e9s et plus<\/strong> : jusqu\u2019\u00e0 <strong>2\u202f% de la masse salariale<\/strong><\/li><\/ul><p>\u00a0<\/p><p id=\"ember7385\" class=\"ember-view reader-text-block__paragraph\">Cela correspond bien aux modalit\u00e9s officielles du dispositif.<\/p><hr class=\"reader-divider-block__horizontal-rule\" \/><h3 id=\"ember7386\" class=\"ember-view reader-text-block__heading-3\">4. Modalit\u00e9s pratiques<\/h3><p id=\"ember7387\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p><ul><li>Le montant est <strong>calcul\u00e9 sur l\u2019ann\u00e9e civile<\/strong>.<\/li><li><strong>Le dossier doit \u00eatre d\u00e9pos\u00e9 au plus tard le 31 mai<\/strong> de l\u2019ann\u00e9e suivante <a class=\"jYriGnCbgYuGbzrKRsWZkYsnLoHFHtXpyjo\" tabindex=\"0\" href=\"https:\/\/www.pixie.lu\/corpus\/rh\/66-0039\/les-asbl-peuvent-elles-beneficier-du-cofinancement-formation-de-l-infpc\/?utm_source=chatgpt.com\" target=\"_self\" data-test-app-aware-link=\"\">Pixie<\/a>.<\/li><li>Les justificatifs accept\u00e9s incluent non seulement les co\u00fbts de formation, mais aussi les frais de d\u00e9placement, le co\u00fbt salarial, etc.<\/li><\/ul><p>\u00a0<\/p><p id=\"ember7388\" class=\"ember-view reader-text-block__paragraph\">\u2705 <strong>Comment ?<\/strong><\/p><p id=\"ember7389\" class=\"ember-view reader-text-block__paragraph\">\u00a0<\/p><ul><li>D\u00e9poser un <strong>plan de formation<\/strong> annuel aupr\u00e8s de l\u2019INFPC avant le <strong>31 mai de l\u2019ann\u00e9e suivante<\/strong>.<\/li><li>Conserver tous les <strong>justificatifs<\/strong> : feuilles de pr\u00e9sence, factures, attestations, contenus\u2026<\/li><li>Utiliser le <strong>Portail <\/strong><a class=\"jYriGnCbgYuGbzrKRsWZkYsnLoHFHtXpyjo\" tabindex=\"0\" href=\"http:\/\/myguichet.lu\/\" target=\"_self\" data-test-app-aware-link=\"\"><strong>myGuichet.lu<\/strong><\/a> pour le d\u00e9p\u00f4t.<\/li><\/ul><p>\u00a0<\/p><hr class=\"reader-divider-block__horizontal-rule\" \/><h3 id=\"ember7390\" class=\"ember-view reader-text-block__heading-3\">Leviers<\/h3><p id=\"ember7391\" class=\"ember-view reader-text-block__paragraph\">Le principal levier, c\u2019est de <strong>changer le regard sur la formation obligatoire<\/strong>. Il ne s\u2019agit pas de cocher une case mais d\u2019<strong>investir dans la ma\u00eetrise, la confiance et la pr\u00e9vention active<\/strong>.<\/p><p id=\"ember7392\" class=\"ember-view reader-text-block__paragraph\">Former, c\u2019est prot\u00e9ger. Et dans bien des cas, c\u2019est aussi <strong>\u00e9conomiser<\/strong> : un salari\u00e9 form\u00e9 aux premiers secours peut sauver une vie. Un employ\u00e9 sensibilis\u00e9 au RPS peut \u00e9viter un burn-out. Un op\u00e9rateur entra\u00een\u00e9 \u00e0 la manutention peut pr\u00e9venir un arr\u00eat maladie de 6 mois.<\/p><p id=\"ember7393\" class=\"ember-view reader-text-block__paragraph\">Autre levier : <strong>anticiper les besoins<\/strong> plut\u00f4t que de r\u00e9agir \u00e0 l\u2019urgence. Quand on identifie les \u00e9volutions du m\u00e9tier, on peut programmer des formations strat\u00e9giques.<\/p><hr class=\"reader-divider-block__horizontal-rule\" \/><h3 id=\"ember7394\" class=\"ember-view reader-text-block__heading-3\">Freins<\/h3><p id=\"ember7395\" class=\"ember-view reader-text-block__paragraph\">Le frein num\u00e9ro un reste le <strong>temps<\/strong>.
