Travailleurs temporaires, int\u00e9rimaires, \u00ab extras \u00bb ou renforts saisonniers\u2026 Dans la course \u00e0 la flexibilit\u00e9, leur s\u00e9curit\u00e9 est trop souvent rel\u00e9gu\u00e9e au second plan. Pourtant, c\u2019est bien l\u00e0 que le risque commence.<\/p>\n\n\n\n<p id=\"ember1469\">C\u2019est dans un atelier de maintenance d\u2019une zone industrielle luxembourgeoise que l\u2019histoire de Karim a pris un tournant brutal. Arriv\u00e9 en int\u00e9rim pour renforcer l\u2019\u00e9quipe pendant les cong\u00e9s d\u2019\u00e9t\u00e9, il n\u2019a b\u00e9n\u00e9fici\u00e9 d\u2019aucune formation. \u00c0 peine le temps de signer sa mission qu\u2019il se retrouvait d\u00e9j\u00e0 devant un pont \u00e9l\u00e9vateur\u2026 sans consignes, sans EPI adapt\u00e9s, sans supervision. R\u00e9sultat : une fracture du poignet et plusieurs mois d\u2019arr\u00eat.<\/p>\n\n\n\n<p id=\"ember1470\">Ce genre d\u2019histoire, malheureusement, n\u2019est pas isol\u00e9.<\/p>\n\n\n\n<p id=\"ember1471\">Selon l\u2019AAA (Association d\u2019assurance accident), les travailleurs int\u00e9rimaires sont 2 \u00e0 3 fois plus expos\u00e9s aux accidents que les salari\u00e9s en CDI, en particulier dans les secteurs du b\u00e2timent, de l\u2019industrie et du transport. Et les causes sont connues : affectation \u00e0 des postes \u00e0 risque, absence d\u2019accueil s\u00e9curit\u00e9, m\u00e9connaissance des consignes, manque d\u2019exp\u00e9rience terrain.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"ember1472\">Des obligations claires\u2026 mais encore trop mal connues<\/h3>\n\n\n\n<p id=\"ember1473\">Le Code du travail luxembourgeois est pourtant explicite. L\u2019entreprise utilisatrice est responsable des conditions de s\u00e9curit\u00e9 du salari\u00e9 int\u00e9rimaire, comme s\u2019il s\u2019agissait de son propre personnel. Elle doit lui assurer un accueil s\u00e9curit\u00e9, des EPI appropri\u00e9s, une information sur les risques du poste, et une formation ad\u00e9quate \u00e0 ses t\u00e2ches.<\/p>\n\n\n\n<p id=\"ember1474\">L\u2019article L.312-1 impose notamment aux employeurs de garantir la protection des salari\u00e9s contre les risques li\u00e9s au travail, quelle que soit la nature du contrat. En clair : un int\u00e9rimaire n\u2019est pas un salari\u00e9 \u201c\u00e0 part\u201d, il est pleinement inclus dans le champ des obligations de pr\u00e9vention.<\/p>\n\n\n\n<p id=\"ember1475\">Mais dans la r\u00e9alit\u00e9, les choses se passent autrement. Pression du temps, turnover \u00e9lev\u00e9, manque de coordination entre l\u2019agence d\u2019int\u00e9rim et l\u2019entreprise utilisatrice : les failles sont nombreuses. Parfois, les documents sont sign\u00e9s \u00e0 la va-vite, les formations survol\u00e9es, les consignes orales donn\u00e9es \u00ab \u00e0 la vol\u00e9e \u00bb par un coll\u00e8gue pas toujours comp\u00e9tent. Le risque devient alors un terrain glissant.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"ember1476\">Qui forme, qui informe, qui assume ?<\/h3>\n\n\n\n<p id=\"ember1477\">Le flou persiste aussi sur la r\u00e9partition des r\u00f4les. Qui doit assurer la formation ? L\u2019agence d\u2019int\u00e9rim ? L\u2019entreprise utilisatrice ? Les deux ? La r\u00e9ponse est\u2026 partag\u00e9e. L\u2019agence d\u2019int\u00e9rim doit s\u2019assurer que le salari\u00e9 envoy\u00e9 est apte et inform\u00e9 des conditions g\u00e9n\u00e9rales. Mais c\u2019est l\u2019entreprise utilisatrice qui reste responsable des conditions de s\u00e9curit\u00e9 sp\u00e9cifiques au poste occup\u00e9.<\/p>\n\n\n\n<p id=\"ember1478\">Un d\u00e9faut d\u2019information, une absence de mise en situation, ou un \u00e9quipement inad\u00e9quat peuvent donc engager sa responsabilit\u00e9 en cas d\u2019accident.<\/p>\n\n\n\n<p id=\"ember1479\">C\u2019est pourquoi l\u2019accueil s\u00e9curit\u00e9 ne peut \u00eatre une simple formalit\u00e9. Il doit \u00eatre structur\u00e9, tra\u00e7able, et compr\u00e9hensible. Un accueil efficace, c\u2019est au minimum : une pr\u00e9sentation des locaux, des risques sp\u00e9cifiques, des bons r\u00e9flexes \u00e0 adopter, des proc\u00e9dures d\u2019urgence, et des gestes \u00e0 ne jamais faire. Le tout id\u00e9alement compl\u00e9t\u00e9 par une formation pratique sur les \u00e9quipements utilis\u00e9s.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"ember1480\">Des leviers pour am\u00e9liorer la situation<\/h3>\n\n\n\n<p id=\"ember1481\">Certaines entreprises commencent \u00e0 inverser la tendance. Chez un grand logisticien bas\u00e9 \u00e0 Bettembourg, tout nouvel int\u00e9rimaire suit un module court de formation s\u00e9curit\u00e9, valid\u00e9 par un quizz et compl\u00e9t\u00e9 par une visite terrain encadr\u00e9e. R\u00e9sultat : en deux ans, le taux d\u2019accidents du travail chez les int\u00e9rimaires a chut\u00e9 de 46 %.<\/p>\n\n\n\n<p id=\"ember1482\">D\u2019autres vont encore plus loin, en int\u00e9grant les int\u00e9rimaires dans leur plan de formation annuel et en leur fournissant un acc\u00e8s \u00e9gal aux briefings s\u00e9curit\u00e9 hebdomadaires. Une bonne pratique qui favorise l\u2019int\u00e9gration, la responsabilisation\u2026 et r\u00e9duit les \u00e9carts de traitement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"ember1483\">Int\u00e9rim ne rime pas avec pr\u00e9carit\u00e9 pr\u00e9ventive<\/h3>\n\n\n\n<p id=\"ember1484\">Rien ne justifie aujourd\u2019hui que la pr\u00e9vention soit moins rigoureuse pour un salari\u00e9 temporaire. Car le danger, lui, ne fait pas de distinction de contrat.<\/p>\n\n\n\n<p id=\"ember1485\">Un accident n\u2019\u00e9pargne ni la fiche de mission, ni la dur\u00e9e du contrat. Il frappe l\u00e0 o\u00f9 la pr\u00e9vention a \u00e9t\u00e9 n\u00e9glig\u00e9e. Et c\u2019est souvent dans ces angles morts, l\u00e0 o\u00f9 le turnover est fort, o\u00f9 les proc\u00e9dures sont floues, et o\u00f9 le temps manque, que le risque s\u2019installe durablement.<\/p>\n\n\n\n<p id=\"ember1486\">Alors posons la question simplement : un int\u00e9rimaire devrait-il \u00eatre moins form\u00e9 qu\u2019un CDI ? La r\u00e9ponse est non.
