Is it legal to outsource my designated worker in Luxembourg?
Yes. The Grand Ducal Regulation of 9 June 2006 requires the appointment of one or more workers responsible for health and safety. When a company does not have competent or available internal resources, the law expressly provides for the possibility of using external expertise. This is the framework within which OFSIP operates.
Are all businesses concerned by this obligation?
Yes, the obligation applies to all businesses, regardless of their size, sector, or risk level. The number of designated workers and the level of training required depend on the workforce size and the positions at risk.
Your company risks a fine if it does not have a designated worker.
The absence of formal designation constitutes a non-compliance that can be identified during an ITM inspection, with associated measures and sanctions. Beyond the legal risk, it is primarily the safety of your employees and your liability in the event of an accident that are at stake.
